In booking a trip with PASSION TREK you are authorising us to make the necessary steps to reserve your trip for you. We shall not be responsible for any liability arising out of your instructions.
We shall require a deposit of 30% of the price of the trip at the time of booking with us. The remainder of the price must be paid one month before the start of the trip. If you book a trip which starts in less than a month then the full price must be paid upfront.
All payments to PASSION TREK must be made by wire transfer directly to the PASSION TREK account as indicated on your invoice.
All information passed between PASSION TREK and you shall be regarded as confidential information and shall not be disclosed unless required by business practices or by law.
PASSION TREK reserves the right to make changes to your trip to take into account any changes in weather or other factors which may affect your trip with us.
If you want to cancel your trip with PASSION TREK you will be entitles to the following refund providing you notify PASSION TREK immediately and you receive confirmation of the notification:
Cancelation 30 to 21 days before the trip = refund of 75% of the cost of the trip.
Cancelation 20 to 8 days before the trip = refund of 50% of the cost of the trip.
Cancelation 7 to 2 days before the trip = refund of 25% of the cost of the trip.
Cancelation less than 2 days before the trip = refund of 10% of the cost of the trip.
The refund shall be paid by PASSION TREK within 30 days of the client receiving confirmation of the cancelation from PASSION TREK.
We shall communicate with you by email in relation to the work being carried by us. Please note that any files we send to you have not been encrypted and therefore may be compromised. It is your responsibility to scan any email and attachments for viruses. We do not accept any liability for transmitting any viruses or infections by email and any consequences which are a direct or indirect result of a transmitted file.
PASSION TREK shall be excused from performing part or all of their obligations and shall not be liable for the imposition of any penalties or be liable for damages if, and to the extent that, they are unable to perform or are prevented from performing their respective obligations due to an event of Force Majeure which means any event, circumstance or condition which is unforeseeable or, if foreseeable, beyond the reasonable control of the affected Party; including (but not limited to):
(a) war, hostilities, revolution, riot, insurrection or other civil commotion, acts of terrorism or sabotage;
(b) strikes, work stoppages, work slow-downs and/or lockouts except any such action by the employees of the Party claiming Force Majeure;
(c) any effect of the natural elements, including lightning, fire, earthquake, sandstorm, flood, storm, tsunami, cyclone or tornado; and
(d) explosion (other than nuclear explosion or an explosion resulting from an act of war);
(e) epidemic or plague.
PASSION TREK is a business trading under Al Barij International LLC, a company duly incorporated in the Sultanate of Oman with company registration number 1/69581/9. The language of all contracts and communications shall be in English. We reserve the right to assign our rights and/or obligations under our agreement with you to any business which is a successor/subcontractor to our current business. Unless otherwise agreed these conditions of business shall apply to all future instructions you give us. The arrangements between us shall be construed and governed by the laws of the Sultanate of Oman and the courts of Oman shall have exclusive jurisdiction.
These terms and conditions shall be governed by the laws of the Sultanate of Oman and the Omani courts shall have exclusive jurisdiction.
